Hardly any Republican members of congress held town hall meetings for this recess. It’s pretty clear why—they’re scared, and they don’t want to answer questions. Since Rep. Ratcliffe is hiding from constituents after this life-and-death vote to repeal and replace the ACA, now’s a good time to refer back to our Missing Members Action Plan for ramping up the pressure on him to hold a town hall and show up for it. An in-person district office visit is also an excellent opportunity to put some of the “die-in” tactics to use. Use our Act Locally map to find an upcoming Indivisible action near you, or add actions that your group is already planning so that other local activists can join you.

Rep John Ratcliffe, (202) 225-6673, voted YES to help pass Trumpcare, the Republican healthcare plan – the American Health Care Act. The House bill would kick 24 million people off of their healthcare, take billions of dollars from Medicare and gut Medicaid. And it give states the option of letting health insurance companies charge sky-high rates to people with pre-existing conditions. This is especially dangerous to the tens of millions of Americans in their 50s and early 60s who are not yet eligible for Medicare. It is now up to the Senate to defeat this heartless legislation. House members who voted to strip 24 million Americans of health care coverage and then celebrated with beers and a White House pep rally must be held accountable. Senators who are considering doing the same must be put on notice.

In 2013, Senator Ted Cruz led a government shutdown that failed in its goal of de-funding the Affordable Care Act, but not before Cruz read the Dr. Seuss classic “Green Eggs and Ham” as part of a 21-hour floor speech. Cruz today is reportedly pushing to allow states to waive Obamacare’s requirement that insurers cover everyone, regardless of health status, and that they not charge people with pre-existing conditions any more than healthy people. From Indivisible TX Lege: If HJR 39 passes the State House, Texas would become one of the 34 states needed to have a US Constitutional Convention. 28 States have approved such measures so far. Given the current political climate, there’s no telling what changes would be made to our Constitution, and how it would impact the separation of powers.

Congress is debating two bills that would prevent the FDA, USDA and EPA from carrying out their missions. These bills undo vital safeguards for bees, agriculture and the environment. And they would make it even harder to enact new protections.

Texas Senate Bill 25 — which would allow doctors to withhold information from pregnant women about the status of their fetus and then, if the child were born with a deformity or disability, prevent the parents from suing the doctor for withholding the information — has passed out of the Senate Committee on State Affairs on an 8-0 vote and is headed to the full Senate.

Sen. Brandon Creighton, R-Conroe, the author of the bill, said current law sends the message that “wrongful births” are real and discriminates against children born with disabilities. “The presence of a disability in a child should not be grounds for a lawsuit,” Creighton said. “I feel that Senate Bill 25, if passed, would be in line with a large majority of Texans and their values.”

The purpose of the bill is to prevent women, who may consider an abortion if the fetus is not properly forming, from deciding whether or not to abort the fetus. Blake Rocap, legislative director for NARAL Pro-Choice Texas, said, “We shouldn’t have to stand up and say that it shouldn’t be policy for the state of Texas to excuse doctors from lying to their patients, and that is what this bill does.”

Creighton has served in the Texas Senate since 2014 and voted against a bill requiring vaccines for minors and against a bill to prohibit texting while driving. I guess because he thinks contracting diseases and being killed while driving are both good things?

GOP bill would force workers to undergo mandatory genetic testing or pay thousands in fines

A creepy new bill that just passed a house committee vote would allow employers to require genetic samples from their workers. Your employer could demand detailed information about your genes, and even discriminate against you in certain circumstances, if H.R. 1313 gets passed.

Privacy of your genetic information has been the law for almost a decade. Current law mandates that genetic information cannot be obtained by an employer unless the employee voluntarily gives it up. Under the Genetic Information Nondiscrimination Act of 2008, also known as GINA, businesses cannot discriminate against current employees or make hiring decisions on future ones on the basis of their genetic makeup. They’re also forbidden “from requesting, requiring or purchasing genetic information” of their current or potential future workers.

But a bill making the rounds on Capitol Hill is hoping to change that. Employers would be allowed under H.R. 1313 to require genetic information from workers if they are part of “workplace wellness” programs.

The bill quietly passed a vote on Wednesday in the House Committee on Education and the Workforce, according to STAT. All 22 Republicans voted in favor of the bill, while all 17 Democrats opposed it. The bill would also allow employers to penalize their workers financially, thousands of dollars per year, if they refuse to submit their genes to the company in a workplace wellness examination.

The proposed bill “opens the door for unscrupulous employers to misuse the information provided to them through workplace wellness programs and exposes employees to illegal discrimination,” said Rep. Bobby Scott (D-VA). H.R. 1313 now awaits a full vote in the House. Should the bill pass the House and Senate and make it to Donald Trump’s desk, it’s likely he would sign it, given his past statements about his belief in eugenics — a theory that people of certain genetic backgrounds are superior to others.

Over February’s congressional recess, we turned out in record numbers to share with Rep Ratcliff what the Affordable Care Act, Obamacare, means to us. We warned him about the serious consequences of repeal—both for the nation’s health and for his reelection chances. Congress took notice. Rep. Mo Brooks (R-AL) said that your objections might prevent them from passing a repeal bill. They think they can get away with rushing their bill through. We can’t let them get away with it. And if we continue to stand indivisible, they won’t.

How to stand indivisible with the 32 million Americans who rely on the ACA

  2. Tell your MoCs to demand a fully transparent process for any legislative action on the ACA, including requiring a public Congressional Budget Office cost estimate (“score”) before any vote. (We won this one!)

The next major congressional recess isn’t until April, and the MoCs pushing for repeal would love to repeal Obamacare before then so that they don’t have to answer any more pesky questions. Our response: Not so fast.

Michael Flynn, the disgraced former National Security Advisor to the Trump Administration, resigned after it was discovered that he lied about illegally contacting Russian officials prior to President Trump’s election and again before the inauguration. A number of additional Trump aides had contact with Russian intelligence officials during the 2016 campaign. Attorney General Jeff Sessions, our top law enforcement officer, lied under oath to cover up his own contacts with the Russian government during the campaign. This is a matter of national security that must be fully investigated by Congress.

An Indivisible TX Redistricting Event
Cindy Burkett (R-Sunnyvale) is the chairwoman of the Texas House Redistricting Committee. Under her leadership, the committee has failed to hold a *single* hearing, a distinction shared by no other committee. This is despite the fact that Texas’ election districts are being invalidated left and right by the district court in San Antonio and there are numerous redistricting reform bills stalled in her committee. She is blocking *all* attempts at reform, or even discussion, and is cynically running out the clock on this legislative session.
Cindy Burkett thinks no one cares about gerrymandering. She thinks she can block reform, hold no hearings, and pay no price for it whatsoever. We will show her the error of her ways. Help us fill the street outside her office on May 21! We need to let the good people of Garland know that their representative is *single-handedly* keeping partisan gerrymandering alive.
We will never rid ourselves of corrupt election maps until we make elected officials fear for their political lives for defending them. The Texas congress will be in session for about another month.
Funding for Texas public schools is on the line. Without the additional funding provided in the House version of the appropriations act, funding per student will actually decrease next year. That additional funding is crucial to student and school success. The state has a constitutional responsibility to provide sufficient resources for our public schools.
Please send a letter or call Sen Craig Estes urging him to support the Texas House version of the state budget with more funding for public education to ensure our schools and students have what they need to succeed.

Ask him how he can possibly defend taking away protections for people with pre-existing conditions, or ripping health care away from more than 22 million people. And there’s one fight in the Senate that can be won this week. The Senate is set to vote on a resolution (S.J. Res. 11) to use the Congressional Review Act (CRA) to permanently do away with a widely supported rule that limits waste of natural gas on public lands. This rule helps keep our communities healthy and prevents emissions of one of the most dangerous greenhouse gases.

If passed, this resolution would amount to an $800 million giveaway of taxpayer revenue, giving oil and gas companies a free pass to waste taxpayer-owned resources while also endangering our climate and public health. They don’t have the votes, and if they can’t get them by May 11, the CRA window closes permanently.

  • Make sure your Senators know you oppose this resolution: Call them today to tell them to vote no on undoing the “BLM Methane and Waste Prevention Rule.” For more information, including fact sheets, call scripts, and talking points, visit the Wilderness Society’s methane toolkit to take action.
